Recreational Water Products, Inc. Web Site User Agreement and Privacy PolicyUser AgreementThis site, located at www.aquachem.com (the "Site"), is owned and operated by Recreational Water Products, Inc. and its affiliated companies (collectively referred to as "RWP") for your personal non-commercial use only. You may not use the Site until you have read and agree to abide by the terms of this User Agreement ("Agreement"). By accessing or using the Site, you expressly accept and agree to be legally bound by this Agreement. Children under thirteen years of age may not use the Site. Changes to this Agreement: RWP reserves the right to change this Agreement at any time. RWP will post a notice of any material change to this Agreement on the Site. By continuing to use the Site after a change is made, you accept and are bound by the modified Agreement. Intellectual Property: You acknowledge and agree that the Site and all of its contents, including but not limited to text, photographs, graphics and software (collectively, "Intellectual Property"), are protected by intellectual property laws and are proprietary to RWP. You may browse the Site and print or download one copy of materials appearing on the Site for your personal, non-commercial use. You may not copy, reproduce, republish, upload, post, transmit or distribute, reverse engineer or otherwise use the Site or any of its contents for any other purpose. The trademark Aqua Chem and other trademarks appearing on the Site are the proprietary trade names and/or trademarks of RWP. You may not use the RWP trademarks without the express written approval of RWP. Nothing on the Site or in this Agreement gives you any license or right to use any of the RWP trademarks or other trademarks on the Site. Warranty Disclaimer: THE SITE AND ITS CONTENTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. RWP DOES NOT WARRANT THAT THE SITE OR ITS CONTENTS WILL BE AVAILABLE OR OPERATE IN AN UNINTERRUPTED OR ERROR-FREE MANNER OR THAT ERRORS OR DEFECTS WILL BE CORRECTED. IN ANY EVENT, THE AGGREGATE LIABILITY OF RWP FOR ANY REASON AND UPON ANY CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THE SITE OR THIS AGREEMENT SHALL BE LIMITED TO YOUR DIRECT DAMAGES ACTUALLY INCURRED UP TO TWO HUNDRED FIFTY DOLLARS ($250). Due to applicable law in certain jurisdictions, the foregoing limitation of liability may not pertain to you. Product Use Disclaimer: This analysis is designed for use only with the Aqua Chem® brand products named in this computerized water analysis printout, and is correct to the best of RWP, Inc.'s knowledge. RWP is not responsible for any use of this printout with products other than the Aqua Chem® brand products named in this printout, and use of this printout with other products could result in improper or incorrect treatment of the pool water. Foreign Jurisdictions: RWP makes no representation that materials on the Site or items available through the Site are appropriate or available to use in locations outside the United States and its territories, and accessing the Site from locations where the contents of the Site or items available through the Site are illegal is prohibited. Those who choose to access the Site from other locations do so at their own initiative and are responsible for compliance with local laws. Disputes: This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflicts of law provisions. You agree to submit to the personal jurisdiction of the courts of the State of Georgia for any cause of action relating to the Site or this Agreement. If a court deems any part of this Agreement invalid, the remaining parts shall remain in full force and effect. Privacy PolicyThis privacy policy explains the privacy practices of Recreational Water Products, Inc. and its affiliated companies (collectively referred to as "RWP") for the www.aquachem.com web site (the "Site"). This privacy policy is subject to the User Agreement for the Site which you can access by clicking here. If this privacy policy changes materially, we will notify you by posting a notice on the Site. Information Collection, Use and ChoiceRWP may collect information from you at several different points on the Site. Some information is personally identifiable information which includes, but is not limited to, your user name, password, first name, last name, phone number, email address, home address and pool specifications. This type of information is referred to as "Personal Data." To provide you with enhanced services and promotional offers, RWP may, from time to time, share the Personal Data collected at the Site with third parties. RWP also may disclose Personal Data in response to legal process or when we believe in good faith that the law requires it, for example, in response to a court order, subpoena or a law enforcement agency's request, or to protect the rights, property or safety of the Site, users of the Site, and others. RWP may monitor site usage statistics such as pages visited by each user. RWP may aggregate this data with data on the pages visited by other users to track overall visitor traffic patterns. RWP may use this use this aggregate information internally or provide it to unrelated third parties such as vendors, potential advertisers, or agencies for various purposes such as to exhibit the amount of traffic to the site and to help plan for technical infrastructure requirements. Pool Specification / Water Analysis DataWhen performing water analysis using the online water analysis tool, we will store customer water analysis information to be used for internal purposes so that we may better serve our customers. SecurityRWP takes reasonable precautions to protect Personal Data from loss and misuse. CookiesWhen you view the Site, we may store some information on your computer. This information will be in the form of a "Cookie" or similar file and can help us in many ways. For example, Cookies allow us to tailor our Site to better match your interests and preferences.
